If you are the only employee of a home-based business, you are exempt from signing up for commuter benefits.

If you are a small business and you are able to demonstrate that all employees are using alternative transportation, such as biking or walking, you will be exempt from signing up for commuter benefits. The determination is made on a case-by-case basis.
